My judge required any and all drug or alcohol related offenses even if you weren't charged with an actual drug or alcohol charge get an evaluation by one of two places. His wife owned one of em. Talk about ethics violations

Corlene, they call this type of shit a "CONFLICT OF INTEREST" violation.

I have to sign a legal document once a year, swearing (or affirming) that I am not benefiting in any way (not just financially) from my position at work.

I'm an old guy, and I KNOW that life ain't fair.  But I would really like know:
Where exactly IS the dividing line that separates people who CAN use their position to personally profit; and those people who CANNOT?

Not surprising, but typically it is those in the upper class that are exempt from such morality clauses:

* I've heard of other instances where a sitting judge requires defendants/litigants to use services provided by a relative of the judge.

* On a more grand scale, a politician with significant investments in the Military Industrial Complex, voting to authorize military action.
-- In a less-corrupt system, any politician that was in such a position would either have to sell any such stocks/holdings--before taking office--that would benefit from military action.  OR, they would recuse themselves from voting on any bill that affected their holdings.

The Western Media really should follow-up on various politicians in such circumstances, and ask them if they still would have voted the same way if they didn't stand to gain financially.

I use a military example above, but it could be ANY BUSINESS or circumstance that is influenced by a politician who stands to profit considerably.

I totally agree, the judge has been brought in front of the judicial qualifications committee and publically reprehanded, the wife just transferred the name to someone else tho, but she is still the principal psychologist who does the so called interviews of new clients.

Good ole judge Cohen.

He doesn't send them off to her directly the defendant has to get an evaluation somewhere tho. And there are only a very select few that offer this service to them at reduced fees.

Her place happens to be one of them.

Also I need to add this, the broward court house is the most ducked up in the state. Almost all have worked in each others firms before being appointed or elected. It truly is the good ole boys club.

Out of 90 some judges in the whole county 2 or 3 are African American maybe 6 or 7 latino. Again, so many get thrown off the bench here, the govs office appoints, and they get a free ride until election time, where most of the time there isn't anyone to run against.

It's real fucked up here

6-mam-

Go right to courthouse, to the judge's office with a letter and er paper work and ask to be put back on the calendar-I am pretty sure she/he will after talking to a neighbor who did just that-just give it to the judge's secretary/assistant in a sealed envelope, mark it personal and confidential-this person too was also told by atty to turn self in, but that is the long way to go about it.

One way or another, this is pretty much the only option. Even if they just take me into custody. I'm just kinda shocked, I guess it's from my lack of experience with this, that this has to be such a complicated and ridiculous matter, from someone not physically being able to attend a single court hearing because of having to go to the hospital.

Trust me, I was in contact with the people I thought I was supposed to be, BEFORE AND AFTER I went to the hospital.

That is crazy, a public defender can't charge you money to represent you. That goes against everything that a public defender is there for. The reason you can get a public defender is that you make under a certain amount of money based on your family size or how many dependents you have.

It's about $18000 for one person in colorado. If you make over what they say is the limit for not being able to hire an outside attorney you can have an appeal sent in to see if they will give you one for whatever reason you make more. You should be able to call them and see what the limit is for your family size to see if you qualify for one. If you do, you need to put in a request for a public defender to take your case.

If you make over what they say you can make to be eligible for a public defender. You need to get an appeal paper from the court and turn it in to see if they will allow you to have one. I am pretty sure there is a way to find out if you have any warrants for you currently but I am not sure how to go about that.

I would research what you need to do to set another court date. You need to get in touch with them as soon as possible and explain why you weren't there. Definitely be as proactive as possible. If it was a probation revocation court date then call your PO and tell her what happened and ask her what you need to do about getting everything sorted out. I really hope they work with you on this. It is so stressful I have been there myself.

I am going through the exact same thing and it is killing me. I had one thing happen and it has fucked my world up to another level. I got one bs ticket and it could end up putting me in jail or prison, costing me $1000 extra, or just cost me a few hundred. I can't afford any of it, I can't make my rent or my probation fees. I also can't afford my insurance, my new tags, the ticket I got, my breathalyzer, or food right now. I am losing it.

Good luck with your case the judicial system is fucked. Feel free to pm me anytime you want I am going through a similar situation and I know how it feels. Hope everything gets worked out.

Let me explain my situation a little further....

I was arrested last october, bonded out, paid for a lawyer (not a PD), plead in april to probation with classes. I haven't been charged with a probation violation yet, no motion to accelerate. I'm required to attend court every 3 months as sort of a review of my progress. That is the court I missed.

I'm sorry if I wasn't clear...

I wasn't qualified to a PD because I bonded out over a certain amount.

I'm working on getting the medical and phone records. I'm just not sure what this little county is going to do with me. It's a very small place. 25000 people in the whole county.

Thank you all for your input and support!

This is kind of like the governor from Florida who spent 60 million in investing in drug testing agencies in his wife's name and then made his campaign about drug testing everyone who gets financial assistance. I think his name was Rick Scott. Such bullshit either way I think, even if he wasn't profiting off it I don't agree with testing. It costs more to drug test the people then it saves by barring people who piss dirty. I don't even think the asshat was ever charged. White collar criminals and crime don't get prosecuted in the same way everyone else is.

Ok that makes more sense. That is weird I have never had anything like that, is it for drug court. Both my cases after sentencing I didn't have to see the judge until I violated and he had to decide what he wanted my punishment to be. If the judge wanted to hear my motion to end my probation early in court he could elect to do so but he always just said no.

They don't have to see you to let you off early they might if they want to hear from you in person but that is not usually the case because they probably want you to stay on probation unless it isn't making them money by having you on. They wont want to take up there docket space if it doesn't earn them more money.

I hope it all works out for you keep us updated. Hopefully the shady judge allows common sense in your court room and doesn't put you in jail or anything. They usually lack any common sense and compassion so I would hope for the best but prepare for the worst.

And unfortunately all the money Rick Scott invested never went to actual use. The state supreme court prevented it from happening. Scott also is the ceo or was the ceo of one of the nation's largest hospital systems. HCA. He was embroiled in a huge medicare fraud scandal too.

But the lovely citizens of florida voted in favor of the good ole boy and let em run florida into the ground some more.

As for being the head honcho at HCA he also prevented the florida state reps from passing medicaid/medicare expansion leavin hundreds of thousands of people still without health insurance. Even tho they may be 225% above the poverty limit either their jobs don't offer benefits or they can't afford em on the market place.

Oh, he also made it a crime to mention climate change in any state issued papers, why would he do that? He's fully tied up in the insurance game too!!

Damn corlene I knew he was a scumbag but that is some pretty shady scumbaggishness. Gotta love white collar crime, I was really surprised when they actually put Martha in prison, but then again you can't mess with their money. I have a feeling he has never seen the inside of a jail cell unless he was building one to profit off of by making more harsh laws. That guy is a dingleberry he really should have all their money taken away and marooned on an island over run with fire ants.

Small town, all the better-you have a legit reason for your absence-I'm pretty sure you won't have a problem-just go into the judges office and hand over your paper work with a note to the judge-and I'm pretty sure she/he will just put you back on calendar.

any update on what ended up happening 6-mam ?

I moved 10 hrs away from where I had court for a DUI and an assault on LEO charge (actually had court for not paying the fines yet) but kept in touch with my probation officer and the court saying I couldn't make that drive just to set up a payment plan and I had just started a new job and couldn't take off yet and it'd cost way too much gas money that could otherwise be used to pay my fines, etc..
They told me to miss court once and then they'd send me another court date and I'd have to make that 2nd court date or they'd issue a warrant for my arrest. It gave me an extra month or so to come up with the money to pay my fines so I didn't have to go to court at all. Paid 'em in full and never had to take off work and drive all that way. It worked out well and I made sure to keep everybody in the loop on what was going on with me and why I wasn't coming to court the first time.

So, still no one has heard from OP? Hope he's alive and ok. Just wanted to add, Rick Scott is finally out of terms for governor. Guess what hes doing? Running for Senate now. He is most recently responsible for deregulation of the sugar industry, causing them to create some toxic pollution green slime that has been released into the gulf and Atlantic, making red tide worse and killing marine life. This mass die off has been going on since last December. Idk If people outside Florida are hearing about this stuff but I want them too.

Furthermore, Florida was given a bunch of federal money to fix and figure out the problem. Guess what Rick Scott did with it? Use more than half on advertising, trying to tell people to still visit Florida... and when they get here there's going to be dead fish, sea turtles and manatees, and air that burns your eyes and throat. At least in my part of Florida.

I know this is a thread derail, but seriously, I can't believe hes isn't going to be a senator here now....and his ads are so full of lies its not even funny. He only won by 1 pts last time, but that was enough to fuck us up here in many ways.
