Is it legal for them to issue a warrant?

I had court today and before I was about to go I fainted and had bad heart palpitations, and I knew I needed to go to the er. So I called them BEFORE I was supposed to be there, the person on the phone said she'd take down my name and try and let the judge know, and to call back that afternoon.

So I call back, and a different person answered, and said she didn't know about it, and they don't take messages! I say how can I go about resolving this and she says if I have a warrant, I need to turn myself in and speak to the judge. I ask for other options she says she can't help me and I can talk to a lawyer. I say I'm supposed to go to the doc again and get more tests before I have a seizure, and how can I do that sitting in jail? She basically said she didn't care, and doesn't know if I even have a warrant.

I can't afford a lawyer/bail/sitting in jail until they let me see the judge.

What the fuck can I do?

I looked at a website that lists warrants, and I don't have one yet. And that site is usually pretty good about updating when I do.

I really don't want to sell my shit and leave the state but I will try to is they refuse to work with me. I think it's bullshit.

Anyone been through something like this before?

This must be very scary for you, not only your health, but having this legal issue hanging over you.

Why not get your ER proof of medical emergency tx, and send a copy to the judge, explaining your absence, and if said judge will put you back on calendar-provide a phone number you can be reached at, and send by certified mail.

I hope you can resolve this quickly, and that you have a reasonable judge!!

I do have my discharge papers and was hoping they were going to accept that, and from talking to the person before it was even time for court, I assumed they would be reasonable. I didn't tell the e.r. I was supposed to be in court for that reason, and I didn't want them to think I was just trying to get out of going. I'm sure the court clerk I talked to assumed that.

If I can get a hold of someone other that that rude ass clerk, I will for sure do everything I can. I really don't know what the hell I'm doing when it comes to this. This is my first time on probation. And people are telling me different things.

It's very frustrating,

Do you have a public defender or another court date set? I am sorry that this is happening to you unfortunately the judicial system has no soul and would probably rather have you die in court than use common sense or courtesy. I hope it all works out for you and that you can get it all taken care of with out getting a warrant or going to jail. Best of luck to you!

No it wasn't an initial appearance or whatever you'd say, it was a DA review for probation. I'm supposed to do them every 3 months, but last time they canceled it.

I am violating my probation though, like I said, I haven't been able to afford classes I'm supposed to take. I was going to ask the judge if I could make up those funds with community service.

I swear it's like everything hangs on one another like jinga pieces, one thing falls through you come tumbling down.

My judge required any and all drug or alcohol related offenses even if you weren't charged with an actual drug or alcohol charge get an evaluation by one of two places. He wife owned one of em. Talk about ethics violations

Here you would talk to your lawyer, and the lawyer would go about setting a new court date.  Even if they issued a bench warrant for failure to appear, they usually withdraw it once you make a new date.  Bench warrants are usually issued for people who drop off the face of the earth.  Obviously this isn't always true.

I would just be proactive about it and you will probably be fine.

Would it be possible for you to fax and snail mail a short explanation to the DA, probation and judge?  Here it's not really likely the judge would ever see it as it would be communication outside of a legal setting (but couldn't hurt imo). I agree w/being as proactive as possible. Let them know you're not trying to skip anything & if you write to them it's a way to prove your intent. Good luck!

He can write in and request a hearing himself with notarized paper work, but it will take forever to process. Public pretender can set a hearing the next day.

It couldn't hurt to try I guess....

Talked to the "public defender", he wants 500 bucks to have him represent me. This doesn't qualify for him to do it for nothing because I haven't really violated my probation yet.. He said the same thing, I should turn myself in :/

That is not an option right now, my kid is going to be out of school for over two weeks and I don't have anyone to watch her.

Unless I really knew they'd let me go, but I don't.

Go right to courthouse, to the judge's office with a letter and er paper work and ask to be put back on the calendar-I am pretty sure she/he will after talking to a neighbor who did just that-just give it to the judge's secretary/assistant in a sealed envelope, mark it personal and confidential-this person too was also told by atty to turn self in, but that is the long way to go about it.

That is crazy, a public defender can't charge you money to represent you. That goes against everything that a public defender is there for. The reason you can get a public defender is that you make under a certain amount of money based on your family size or how many dependents you have.

It's about $18000 for one person in colorado. If you make over what they say is the limit for not being able to hire an outside attorney you can have an appeal sent in to see if they will give you one for whatever reason you make more. You should be able to call them and see what the limit is for your family size to see if you qualify for one. If you do, you need to put in a request for a public defender to take your case.

If you make over what they say you can make to be eligible for a public defender. You need to get an appeal paper from the court and turn it in to see if they will allow you to have one. I am pretty sure there is a way to find out if you have any warrants for you currently but I am not sure how to go about that.

I would research what you need to do to set another court date. You need to get in touch with them as soon as possible and explain why you weren't there. Definitely be as proactive as possible. If it was a probation revocation court date then call your PO and tell her what happened and ask her what you need to do about getting everything sorted out. I really hope they work with you on this. It is so stressful I have been there myself.

I am going through the exact same thing and it is killing me. I had one thing happen and it has fucked my world up to another level. I got one bs ticket and it could end up putting me in jail or prison, costing me $1000 extra, or just cost me a few hundred. I can't afford any of it, I can't make my rent or my probation fees. I also can't afford my insurance, my new tags, the ticket I got, my breathalyzer, or food right now. I am losing it.

Corlene, they call this type of shit a "CONFLICT OF INTEREST" violation.


I have to sign a legal document once a year, swearing (or affirming) that I am not benefiting in any way (not just financially) from my position at work.


I'm an old guy, and I KNOW that life ain't fair.  But I would really like know:
Where exactly IS the dividing line that separates people who CAN use their position to personally profit; and those people who CANNOT?


Not surprising, but typically it is those in the upper class that are exempt from such morality clauses:


* I've heard of other instances where a sitting judge requires defendants/litigants to use services provided by a relative of the judge.


* On a more grand scale, a politician with significant investments in the Military Industrial Complex, voting to authorize military action.
-- In a less-corrupt system, any politician that was in such a position would either have to sell any such stocks/holdings--before taking office--that would benefit from military action.  OR, they would recuse themselves from voting on any bill that affected their holdings. 


The Western Media really should follow-up on various politicians in such circumstances, and ask them if they still would have voted the same way if they didn't stand to gain financially.


I use a military example above, but it could be ANY BUSINESS or circumstance that is influenced by a politician who stands to profit considerably.
