BC Supreme Court Strikes Down Drug Trafficking Provision, Frees DULF Founders

Summary

The BC Supreme Court (Justice Catherine Murray) has ruled that section 5(2) of the Controlled Drugs and Substances Act (possession for the purpose of trafficking) violates the Section 7 and Section 15 Charter rights of the Drug User Liberation Front (DULF) co-founders, Jeremy Kalicum and Eris Nyx, and of people who use drugs.

  • The ruling: s. 5(2) is declared invalid (of no force or effect), effective six months from the ruling, giving the legislature time to craft a response.
  • The founders: a stay of proceedings was entered. No convictions will be recorded, and they cannot be prosecuted again for the compassion club activities in question.
  • What DULF did: sourced heroin, methamphetamine and cocaine from the dark web, tested it rigorously for purity and potency, and sold it at cost to members of a strictly controlled compassion club. This gave members a regulated, predictable supply instead of the street supply that has killed more than 18,000 people in BC over the past decade.
  • The prosecution: Kalicum and Nyx were convicted in November 2025 on three counts each of possession for the purpose of trafficking. Per the Coalition, the club had been supported or tacitly permitted by government agencies until political winds shifted in September 2023 and politicians publicly targeted it. Vancouver police raided DULF on 25 October 2023, sending members back to the unregulated supply.
  • The court's findings: "a non-medical safe supply is urgently needed to save lives", and the club "reduced the harms associated with the toxic drug crisis and did not negatively impact the community or public safety."
  • Next: Canada has six months to legislate. The Coalition expects the Crown to appeal, which would delay any change.

Comment

The core of the argument is that the law was a dead end by design. A safer-supply program needs a lawful source of drugs, and the law made sure none existed. DULF's lawyers argued that, given that, it is the law and not the founders that is wrong. The court agreed.

The ruling legalises nothing, and it has no force in Australia. What matters is the reasoning. A court has now accepted, on evidence, that prohibition itself contributes to the deaths it claims to prevent, and that a tested, community-run supply is a safer alternative to the street market. That is a claim harm reduction advocates have made for years. It now sits in a judgment after expert testimony.

Watch two things. First, whether the Crown appeals, which looks likely. Second, what Parliament writes into the "pathway to non-medicalized safer supply" if the six-month clock runs. Legislation drafted grudgingly could give back much of what the ruling won. Whatever happens, the stay frees two people who risked prison to keep others alive, and the judge's closing words to them are worth reading in full on the Coalition's page.
