At least three different lawsuits for defamation behind dumb-ass pharmacists making irresponsible comments to patients presenting narcotics prescriptions.

Sorry about the last one, there's not any good, succinct summary of the case except for on Justia but that page won't load for me.

In a nutshell, these three cases have met the minimum legal requirements for standing and are moving forward. They are very similar, and involve patients being refused filling prescriptions by these doctors, when pharmacists inform the patients (falsely) that the doctors are "being investigated by the DEA," "are irresponsible," and that they should "find a new doctor because this one is not going to be in business for much longer."

One of the plaintiffs states that pharmacists actually told his patient that he was a "murderer."

In my opinion, these are cases that need to be filed, because a clear case of defamation (injurious, false statements made) exists. I hope CVS and Walgreens get their asses smacked good and hard here, (and that these doctors don't end up with some dead patients on their hands before the decisions are rendered - that wouldn't look to good).

Some large sums of money are going to change hands with these cases, I predict.

Too bad none of em are class action. I've had a walgreens pharmacy manager deny a script for 15 fent patches and 90 opana ir a while ago, around 2010.

From the same PM doctor I have now actually. And she called my contact number on file which was my mother's at the time, and told her x you and z medicine is not available and can't order it because she doesn't agree with the diagnosis (crps and failed fusion)

I don't care about the bitch saying she wouldn't fill it, she had no right telling anyone about any of my medicines, nor what the medication was for, there was a dx on the script as most pm doctors routinely put them on there, she told my mom everything about ,me she didn't need to know.

I called the district pharmacy manager, and guess what. That same pharmacist filled my script three days later. I got a giftcard too! Cunt.

My 23 year old sister couldn't get her 10 mg oxycodone script filled with her fioricet because the pharmacist didn't agree that opiates help her severe headaches. That was at cvs a couple weeks ago. Said the doctor is known to over prescribe. She just went across the street to Publix and filled it there.
 
I refuse to support any major chain pharmacy. Total bullshitbaith any controlled drug here in S FL. I only use my hospitals and a specialty/infusion pharmacy owned by àn awesome cuban family.

It's only the major chain pharmacies that are giving people shit though. Regional places, mom and pops, no problem filling there.

If your not an established patient with documented upward titration walgreens/cvs will not fill dilaudid 8 or oxy 30. They'll say they don't have them, or their back ordered, if your doc really is a quack they'll say they don't honor that doctors script here etc.

You could sue for being told this shit? Man oh man

It's not the patients suing, it's the doctors. And I think for good reason. Their patients are being told completely untrue (not under DEA investigation) and inflammatory (your doctor is basically a quack and he won't be in business much longer) things which do real damage to their business. That's defamation, slander and just a plain old asshole move on the pharmacists' part.

But hey that's super fucked about you being told by the pharmacist that he didn't "agree with the diagnosis." WTF? Did he examine the patient and consult with him? That's fucked up on a couple different levels.

And the one about your sister being told that opiates wouldn't help with her headaches - since when are narcotics not a bona fide treatment for pain? I mean for neuralgia, that's a possibility, but still they do get prescribed for that too, and help some people.

People in positions of authority seem to be routinely overstepping their bounds. I don't know if this is becoming more prevalent in our society, but is sure seems like it (police come to mind for one thing). Of course we've always had this happening but it just seems to be more and more commonplace these days. Maybe I'm just more aware of it nowadays with some life experience under my belt.

My wife and I have been treated poorly at Walgreens and CVS. Everything from phone calls asking my wife," what are you trying to pull" for merely trying to change to their pharmacy that was across the street from our house, instead of the Wal-Mart across town to flat out refusing to fill a script from a different major city,although both were in the same state.

The medications we are prescribed are between ourselves and our doctor. Now we have not only the dea telling doctors how to practice medicine, we have pill counters given the responsibility of second guessing medical doctors.

I know that pharmacists are most often  highly educated,intelligent individuals,who could have chosen almost any profession. However,they chose to be  pill dispensers,not prescribers, so know your role and do your job.  I routinely observe Hippa violations, judgemental attitudes, and the second guessing of what my doctor and I have discussed at length.

In addition, I now count my controlled meds at the counter and have been since I came up 45 short on a 90 ct of bars a few years ago.
I won't even get into the pharmacists that refuse to sell the "morning after " pill due to religious or other reasons. I'm embarrassed,in pain, and ready to get home. Stfu,count my pills correctly,and send me on my way.

I had no intention of going to a chain, ESPECIALLY CVS!
Any place that claims moral superiority as a reason to not sell rigs
doesnt deserve a single penny of my money

I know that its pretty common for pharmacists to be like this here in FL

@tta,

Those so called lists do exisit AND they can see top prescribers on certain meds in a specified area in the pmp.

The pmp is pretty neat on how it generates reports on doctors, pharmacists and patients.

Don't goto walgreens or cvs, you'll have a hell of a time filling your script. Costco and Sam's Club are very cheap and generally will fill tho. The mom and pops will rape you unless you use your insurance.
