How to Accurately Measure Tolerance ?

now, the truth is that today's alcohol (for example) roadside tests will haul in anyone over a certain concentration/ml. of blood.

... but we opiate users know that in many cases, the tolerant drinker can present as almost totally sober YET the poor guy is charged.

so, how does one measure tolerance ? thoughts ?
